(LifeSiteNews) — An Israeli court has cleared Yona Simcha Schreiber of criminal responsibility for a brutal attack on a French Catholic nun in Jerusalem, claiming he suffered from a debilitating mental condition at the time of the violent assault.

The Jerusalem Magistrate’s Court delivered the verdict on Wednesday in the case of the 36-year-old resident of the illegal West Bank settlement of Peduel, ruling that the assailant be hospitalized for up to six years.

On April 28, the Jewish settler brutally assaulted the petite nun—a researcher at the French School of Biblical and Archaeological Research—while she was identifiable by her religious clothing. With a running start he approached her and at a full stride slammed her to the ground, causing her head to strike the stone walkway, leaving her dizzy. Moments later he returned and kicked her as she remained down, then turned on a passerby who tried to stop the assault.

The Catholic nun sustained bruises to her face and leg and needed immediate medical attention.

This happened on Mount Zion near the Upper Room where Jesus Christ held the Last Supper with His apostles and instituted the Holy Eucharist. Video footage captured the violent incident.

Schreiber faced charges of committing an assault causing actual bodily harm motivated by hostility toward a religious group, plus common assault.

According to a report in the Jerusalem Post, Judge Ophir Tischler affirmed that the evidence proved Schreiber carried out the acts detailed in the indictment, but accepted the district psychiatrist’s claim that Schreiber “was psychotic at the time and could neither understand the nature of his actions nor stop himself from carrying them out,” and as a result, he was deemed not criminally responsible for the brutal assault.

According to the court order, Schreiber’s hospitalization—beginning August 24—can last no longer than six years, the maximum penalty tied to the most serious charge in the case.

After the prosecution initially leaned toward accepting an acquittal paired with hospitalization, it requested a brief postponement when the Catholic nun’s lawyer appeared at a hearing on Monday and stated she had not been properly informed of the psychiatric alibi.

The nun’s attorney, Zaki Sahlia, challenged the conclusions of the psychiatric report arguing that Schreiber’s choice to target the nun specifically, rather than others present, cast doubt on whether the supposed illness sufficiently explained the violence.

Sahlia further linked the episode to a wider pattern of harassment and attacks directed at Christian clergy in Jerusalem. At the concluding hearing he indicated the nun remained uncomfortable with the psychiatric alibi but accepted the court’s decision.

The ruling has been reported amid concerns over ongoing and escalating attacks by Jewish terrorist settlers against Christian Palestinians, their religious sites in Jerusalem and the West Bank, along with the broader Palestinian population, for which such criminals are routinely not held accountable by Israeli officials.

Hate crimes against Christians ‘mostly go unpunished,’ mental health alibi common

Latin Patriarch of Jerusalem Cardinal Pierbattista Pizzaballa has publicly linked this ongoing rise in aggression to the political climate under Israeli Prime Minister Benjamin Netanyahu’s current government, which was formed in late 2022.

In the spring of 2023, the Franciscan cardinal stated that extremists “feel they are protected … that the cultural and political atmosphere now can justify, or tolerate, actions against Christians.” He described the frequency of such attacks against Christians as “something new” at the time.

Additionally, Church leaders have repeatedly complained that many perpetrators of such crimes face little or no accountability, with many of the assailants being treated as having mental health issues rather than deliberate malice.

In addition to the ongoing aggressions of Jewish settler terrorists against the Christian town of Taybeh in the West Bank, such anti-Christian hate crimes have included radical Jews attempting to assault an Orthodox bishop and priest during a Sunday morning Divine Liturgy, another smashing a statue of Jesus Christ at the Church of the Flagellation, radical Jewish gangs attacking Christian pilgrims and committing vandalism, the desecration of Christian cemeteries, the long-standing common incidents of their spitting on Christians, and on other occasions torching their churches.

Further, Church leaders continually emphasize that such crimes mostly go unpunished by the local Israeli criminal justice system, which leads to encouraging their escalation.

“We see that most incidents in our quarter have gone unpunished,” lamented Father Aghan Gogchian, chancellor of the Armenian Patriarchate. In his April 2023 statement, the priest went on to convey his disappointment that law enforcement authorities don’t prosecute the culprits of such anti-Christian hate crimes with the grave charges they deserve, but rather legally accommodate their crimes construing them as individuals suffering from mental illness.

“The police try to paint each attack as something isolated, and try to paint the attackers as mentally unstable,” Amir Dan, spokesman for the Franciscan Custody of the Holy Land, told The Times of Israel in March 2023. “In doing so, the police remove themselves from all responsibility.”

Yossi Eli, a Jewish Israeli journalist who dressed as a Catholic priest for a day and issued a 2023 report on the harassment he received from fellow Jews, completely rejected the common alibi advanced by Israeli officials in these cases, that their fellow Jews carrying out these crimes are “mentally ill.”

“Our investigation proved that the attacks are absolutely not the work of the mentally ill, but rather people with a clear mind who simply hate something they are not,” Eli reported in a tweet at the time. “They’ve been brainwashed to believe that Jesus is evil. Young extremists, children, and most tragically soldiers—’salt of the earth’—are expressing their hatred toward Christianity.”

Israeli ‘justice’ system ‘designed to create the appearance of accountability while preventing any real consequences’

Further corroborating the corruption of the criminal justice system in Israel is an April report from Euro-Mediterranean Human Rights Monitor which documents “systematic and widely practiced” sexual torture of Palestinian detainees as being “part of an organized state policy” in Israel receiving “full protection from the highest political, military, and judicial authorities.”

In presenting their findings relating to the complicity of Israeli officials in the justice system, this analysis stated that Israel’s court system “has not functioned as an effective mechanism for accountability.” Instead, “it has been historically and systematically employed to entrench impunity for crimes committed against Palestinians, effectively making the judiciary the first line of defense for Israeli violations and their perpetrators.”

Therefore, as echoed by at least some former and current members of Israel’s Knesset, the Euro-Med report argues the cover provided by the Israeli “justice” system establishes complicity with crimes committed against Palestinians, and that this is intentional:

The available data do not point to an incidental procedural failure or a lack of capacity, but rather a structural failure in the ‘will’ to conduct serious investigations and effective prosecutions, turning internal investigations into formal procedures designed to create the appearance of accountability while preventing any real consequences and ensuring the practical protection of the perpetrators and the chain of command, rather than seeking the truth or justice for the victims (author’s emphasis).

In further support of their findings, the human rights organization contrasts the enormous number of filed complaints against Israeli soldiers for crimes against Palestinians with the extremely low indictment rate that has historically “not exceeded 0.81 per cent.”

Dramatic case: Charges dropped against Israeli soldiers caught on video raping Palestinian detainee

In another even more dramatic case, five Israeli soldiers who were indicted in 2025 after video was leaked to the public showing them violently raping a male Palestinian detainee at Sde Teiman, had all charges against them dropped five months ago in March.

Their brief arrests for the grave sexual violence sparked illegal settler factions to riot in their defense and storm the facilities where they were being held at the time. It also prompted a debate in a Knesset committee where one Israeli MP fiercely argued that it is acceptable to rape Palestinian detainees or torture them in any other way.

According to the case’s indictment, the victim sustained broken ribs from the beating he received, a punctured lung, and an internal rectal tear for which he underwent surgery.

After the charges against the rapists were dropped, Israeli war chief Israel Katz apologized to them for the “injustice” they endured, and Prime Minister Benjamin Netanyahu called the allegations a “blood libel.” Since their indictment, they have enjoyed celebrity status in a nation where at least 75 percent of Jewish Israelis indicate support for the Gaza genocide, believing “there are no innocents in Gaza.”

During the final hearing in the case against Schreiber on Wednesday, the prosecution said it had fulfilled its obligations toward the assaulted Catholic nun, listened to her perspective, but sided against her in favor of the psychiatric opinion. Both the prosecution and the defense then jointly requested the court acquit the violent Jewish assailant.

“We hope the medical treatment will help him return to optimal functioning,” said Schreiber’s public defender, Idan Gamlieli. “It is important to note that we understand the complainant’s difficult feelings and wish her recovery from the consequences of this regrettable incident.”
