"(LifeSiteNews) — A bill introduced in the 118th Congress would grant U.S. citizens serving in the Israel Defense Forces (IDF) the same employment and financial protections provided to members of the U.S. armed services.
H.R. 8445, sponsored by Republican U.S. Reps. Guy Reschenthaler of Pennsylvania and Max Miller of Ohio, sought to amend Title 38 of the U.S. Code and the Servicemembers Civil Relief Act (SCRA) to recognize IDF service as equivalent to U.S. uniformed service for purposes of the Uniformed Services Employment and Reemployment Rights Act (USERRA) and the SCRA.
The legislation would extend USERRA job protections, including reemployment rights and safeguards against discrimination, as well as SCRA benefits such as interest rate caps on debts (typically 6 percent), delays on evictions and foreclosures, lease termination rights, and stays in certain civil court proceedings.
As reported by Military.com earlier this week, sponsors stated the measure would support over 20,000 American citizens serving in the IDF. In their press materials, they described the volunteers as fighting terrorism alongside a key U.S. ally and argued the U.S. should provide these protections. The bill was referred to the House Veterans’ Affairs Committee but did not advance before the end of the congressional session in January 2025.
Recent reports have noted renewed discussion of the proposal.
Critics have raised concerns that the bill extends U.S. legal protections to service in a single foreign military without corresponding benefits to U.S. national security. These voices noted that such protections have traditionally been reserved for U.S. service or, in limited historical cases, allied forces under U.S. command. No equivalent measures exist for Americans serving in other allied forces such as Ukraine’s International Legion.
Opponents also object to the use of statutory language in this bill feigning to support U.S. defense requirements.
At the time of introduction, Veterans for Peace (VFP) issued a statement opposing the legislation, arguing it misapplies provisions meant for American national defense:
The resolution would amend sections 3902 and 3914 of US Code 50 which ‘ … provide for, strengthen, and expedite the national defense … to enable such persons to devote their entire energy to the defense needs of the Nation … ’ and to protect U.S. citizens ‘serving with the forces of a nation with which the U.S. is allied … ’
Addressing this question, former VFP president Barry Ladendorf said, “The use of the term ‘defense needs of the nation’ can only mean the United States or nations allied with the United States, as with Britain in World War II. By no stretch of the imagination can one argue that Israel’s ongoing genocide of the Palestinian people is essential to the defense needs of the United States.”
Support for Israel has collapsed in the US
Analyses in Responsible Statecraft and other outlets highlighted that the bill would place obligations on U.S. employers, lenders, and courts to accommodate service in the IDF, potentially creating precedents for other foreign military service.
And in a Monday report from Middle East Monitor (MEM), critics further noted that conversation regarding this proposal comes “when American sentiment toward Israel has shifted decisively in the opposite direction.”
The outlet cited a recent Pew Research Center poll that confirmed a profound shift in American opinion against support for Israel and in favor of the Palestinians, even among Republicans, especially young people and those who identify as “moderate or liberal.”

In summation, the poll “found that 60 percent of Americans now hold an unfavorable view of Israel, up nearly 20 percentage points since 2022.” Furthermore, “the proportion holding a ‘very unfavorable’ view has tripled in that period,” as summarized by the outlet.
“Among Democrats and Democratic-leaning independents, the figure has reached 80 percent. Even within the Republican coalition championing the Bill, 57 percent of Republicans aged 18 to 49 hold an unfavorable view of Israel,” MEM presented.
However, as of yet, the measure has not been reintroduced in the current Congress.
Massive numbers of war crimes committed by IDF soldiers
Since October 2023, LifeSiteNews has reported on alleged crimes by IDF soldiers in Gaza citing Euro-Med Human Rights Monitor and other sources.
The horrendous offenses include systematic sexual torture and rape of Palestinian detainees — using objects, animals, and filming assaults — as a state-sanctioned policy amounting to torture, war crimes, crimes against humanity, and acts contributing to genocide.
The outlet also covered the IDF shooting thousands of unarmed Palestinians seeking food aid and then bulldozing their corpses, as well as soldier-uploaded footage in a documentary showing apparent torture, starvation, targeted killings of civilians and journalists, and other atrocities as part of a “live-stream genocide.”
Additional reports highlight starvation tactics, extremist rabbinical calls to kill civilians, and death tolls exceeding 72,000 Palestinians, including tens of thousands of children.
Furthermore, testimonies from volunteer American medical personnel of massive numbers of children being deliberately sniper shot in the head and heart are confirmed by many IDF soldiers themselves confessing to murdering children.
As some nations move to prosecute, US shields IDF suspects
In response to such reports, law enforcement authorities in nations like Belgium, Brazil, Morocco, and Turkey have moved to detain, arrest or prosecute Israeli soldiers (or former soldiers) on their soil in connection with alleged international war crimes committed during the ongoing Gaza genocide.
While U.S. authorities have reportedly intervened to protect IDF soldiers from prosecution in at least one foreign nation, there remains no evidence that they have sought to investigate any of the many thousands of Americans who enlisted and served in a foreign army that has been broadly recognized as having committed massive numbers of war crimes.
